Guardianship Litigation
A guardian can be appointed by the Court if a person becomes incapacitated and is determined to be incapable of handling his or her own affairs. A guardian may be responsible for all of the person’s financial affairs and personal decisions. Sometimes a guardianship is reasonable or necessary; however, family members may allege an elderly person is mentally incapacitated in order to remove his or her financial control for the personal benefit of the family members.
